体育赛事转播中侵权纠纷的请求权基础争议较大。体育赛事不是著作权的客体，其视听记录的录像制作者权以及广播组织权对于互联网播放的规制乏力。尤其在未来人工智能主导的体育赛事传播中，视听记录播放的智能化和内容多样性将颠覆体育赛事视听记录制作者和信号传输者的传统版权法地位。认为：应通过《体育法》确立体育赛事专有权，在此基础上，赋予体育赛事转播权人与其独占许可地位相称的独立侵权诉讼请求权。
Abstract：There are large numbers of controversies in the regulation of the infringement disputes about sporting events'broadcasting. As the sporting event is not the subject of copyright,the right of video authorship and broadcasting organizers'right of audiovisual records of sporting events are both equally weak to regulate the internet broadcasting. Especially in the future of artificial intelligence-led sporting events broadcasting,the intelligent nature and content diversity of audiovisual records of sporting events by AI will deauthorize the traditional position of audiovisual records producers and transmitters.It is proposed that the exclusive rights of sporting events should be established in the Sports Law,and on this basis,the broadcasting organizers'right of sporting events are granted with independent claims right to infringement that are commensurate with their exclusive licensing status.
