体育领域的技术不当应用起到了类似于兴奋剂的效果，不仅违背了反兴奋剂规范的整体立法宗旨，阻碍了体育公正，消解了运动员的主体性，也危害了体育项目的长远利益。在现有规范体系下，国际、国内的上位法均未承认技术兴奋剂的法律地位，导致了诸多弊端。我国应从法律角度合理界定技术兴奋剂的构成，特别是其与不公平优势之间的因果关系，并从立法、司法和执法三方面入手：①推动《世界反兴奋剂条例》承认技术兴奋剂的违法性；②推动国际体育仲裁院形成统一、协调、连贯的裁判立场；③推动各单项体育联合会制定更具约束力的监管措施，构建反技术兴奋剂的立体规范体系，切实维护我国的正当体育利益和全世界的体育公正。
Abstract：The misuse of technology in sport functions as stimulants, which not only violates the legislative purpose of anti-doping rules, but hinders the fairness and justice of sports competitions, dispels the subjectivity of athletes, and endangers the long-term interests of specific sports. Under the existing regulatory system, the legal status of anti technology doping law has yet to be found in the higher-level laws domestically and abroad, leading to multiple legal problems. Therefore, China should rationally define the composition of technology doping, especially its causality with unfair advantages, and take actions from three perspectives, namely, legislative, judicial and enforcement: to promote World Anti-Doping Code to acknowledge the illegality of technical stimulants; to push the formation of a unified, coordinated and coherent judgment attitude of CAS; and to promote the formulation of more coercive regulatory measures and regulatory system of anti technology doping, thus to effectively safeguard the legitimate interests of sports.
